LEGAL RESPONSIBILITY

1. INTRODUCTION

This document sets out the legal responsibility of relevant parties when using the VNMaterial platform, including the responsibility of VNMaterial, suppliers, users, and third parties.

2. VNMATERIAL RESPONSIBILITY

2.1. Platform Responsibility

  • Maintain and operate the website in a stable and secure manner.
  • Protect user personal information in accordance with the law.
  • Provide tools and features for effective use by users.
  • Handle complaints and violation reports seriously and promptly.

2.2. Limitation of Liability

  • We will handle violating content when reported.
  • We are not responsible for content that has not been found to violate.

3. SUPPLIER RESPONSIBILITY

3.1. Responsibility for Products and Services

  • Fully responsible for the quality and safety of products and services provided.
  • Ensure products and services are legal and properly licensed.
  • Comply with quality and safety standards under the law.
  • Compensate consumers if products cause damage.

3.2. Responsibility for Information

3.3. Responsibility for Transactions

3.4. Compensation Responsibility

  • Compensate VNMaterial if violations cause damage.
  • Compensate users and third parties if products or services cause damage.
  • Bear all legal and dispute resolution costs arising from violations.

4. USER RESPONSIBILITY

4.1. Usage Responsibility

  • Use the website for its intended purpose and do not violate the law.
  • Do not use website information for illegal purposes.
  • Responsible for purchasing decisions based on website information.
  • Verify information before deciding to transact.

4.2. Responsibility for Posted Content

  • Responsible for reviews, comments, and images you post.
  • Do not post content that violates law or ethics.
  • Do not post content that defames suppliers or others.
  • Compensate if posted content causes damage to third parties.

4.3. Security Responsibility

  • Keep login information secure and do not share with others.
  • Responsible for all activity under your account.
  • Notify immediately if you detect unauthorized account use.

5. DATA SECURITY RESPONSIBILITY

5.1. VNMaterial Responsibility

  • Apply appropriate security measures to protect user data.
  • Comply with the Cybersecurity Law and personal data protection regulations.
  • Notify users immediately if a security breach is detected.
  • Do not share personal information with third parties without consent.

5.2. Limitation of Liability

  • No absolute guarantee of data security (no system is completely secure).
  • Not responsible for security breaches due to user error (e.g. sharing password).
  • Not responsible for damage from external cyber attacks beyond our control.

6. INTELLECTUAL PROPERTY RESPONSIBILITY

6.1. VNMaterial Responsibility

  • Protect VNMaterial's own intellectual property (logo, design, source code).
  • Handle copyright infringement complaints upon valid notice.
  • Remove infringing content after verification.

6.2. Supplier and User Responsibility

  • Fully responsible for IP infringement related to content they post.
  • Compensate rights holders if infringement occurs.
  • Do not use VNMaterial content without permission.

7. DISPUTE RESPONSIBILITY

7.1. Disputes Between Users and Suppliers

  • VNMaterial does not directly participate in transactions and is not responsible for disputes.
  • Parties are encouraged to resolve through negotiation and mediation.
  • We may assist in providing information or evidence if requested.
  • If unresolved, parties may bring the matter to the competent courts.

7.2. Disputes With VNMaterial

  • Resolution will be sought first through negotiation and mediation.
  • If unresolved, disputes will be brought to the competent courts of Vietnam.
  • Vietnamese law applies.

8. DAMAGE RESPONSIBILITY

8.1. Limitation of Compensation

To the maximum extent permitted by law:

  • VNMaterial is only liable for direct damage caused by its own fault.
  • Not liable for indirect, incidental, or consequential damage.
  • Maximum compensation does not exceed service fees collected (if any).

8.2. Exemption from Liability

VNMaterial is exempt from liability in the following cases:

  • Damage due to fault of users or suppliers.
  • Damage due to force majeure (natural disaster, war, etc.).
  • Damage due to technical errors beyond our control.
  • Damage due to conduct of third parties.

9. RESPONSIBILITY TO GOVERNMENT AUTHORITIES

  • VNMaterial fully complies with Vietnamese law.
  • Cooperates with competent government authorities when required.
  • Provides information and data as required by authorities (in accordance with the law).
  • Responsible for compliance with e-commerce, tax, and consumer protection regulations.

10. THIRD-PARTY CONTENT RESPONSIBILITY

  • VNMaterial does not control and is not responsible for content on linked websites.
  • Not responsible for services or products of third parties advertised on the website.
  • Users assume the risk when accessing external links.

11. INSURANCE AND WARRANTY

  • VNMaterial makes no warranty as to the accuracy or completeness of information on the website.
  • Does not guarantee that the website will operate continuously without interruption.
  • Does not guarantee results from use of the website.
  • The website is provided "as is".

12. LIMITATION PERIOD FOR CLAIMS

  • Any claim regarding legal responsibility must be submitted within 12 months of the event.
